GORDON v. STATE, DEPT. OF PROF. REG

District Court of Appeal of Florida, Third District
Sep 15, 1992
603 So. 2d 134 (Fla. Dist. Ct. App. 1992)

Opinion

No. 91-1149.

August 11, 1992. Rehearing Denied September 15, 1992.

An Appeal from the Dept. of Professional Regulation, Const. Industry Licensing Bd.

Paula R. Young, and E. Joseph Ryan, Jr., Miami, for appellant.

Wellington H. Meffert, II, and Lisa S. Nelson, Tallahassee, for appellee.

Before NESBITT, COPE and GODERICH, JJ.

Louis Gordon appeals the suspension of his license and the imposition of a fine entered against him by the Construction Industry Licensing Board. Because it appears that Gordon may have been misled regarding the procedure for bringing to the Board's attention a post-hearing settlement, we reverse the order under review and remand with directions to reopen the record for that purpose. We express no opinion on what weight should be given to such information.

Reversed and remanded.
