MEMORANDUM ADOPTING SECOND INITIAL REPORT AND RECOMMENDATION OF UNITED STATES MAGISTRATE JUDGE

The above-entitled and numbered civil action was referred to United States Magistrate Judge Kimberly C. Priest Johnson, who issued a Report and Recommendation (Dkt. #25) concluding that Movant's motion for summary judgment (Dkt. #20) should be denied. The Report and Recommendation, which contains proposed findings of fact and recommendations for the disposition of such action, has been presented for consideration. Petitioner did not file objections to the Report and Recommendation. The court, after review of the record, concludes that the findings and conclusions of the Magistrate Judge are correct and adopts the same as the findings and conclusions of the court.

United States Magistrate Judge Christine A. Nowak has since been assigned this action. --------

It is accordingly ORDERED that Movant's motion for summary judgment (Dkt. #20) is DENIED.
