This case is currently calendared for trial at the Court's Washington, D.C. trial session scheduled to commence Monday, May 8, 2023. The Court held a pretrial telephone conference with the parties on Thursday, February 9, 2023. Petitioner's counsel requested that the case be set for trial at a date and time certain within the weeklong session. The Court agreed to grant the date and time certain but encouraged the parties to continue their work on stipulating the facts of the case, since it appears that the disagreement in the case may be a legal dispute, not a factual dispute. Consistent with the discussion that took place during the phone conference, it is

ORDERED that this case will be called for trial during the Court's May 8, 2023, Washington, D.C., session for at a date and time certain of 2:00 p.m. on Thursday, May 11, 2023, in the South Courtroom, of the United States Tax Court, 400 Second Street, N.W., Washington, D.C., 20217. The parties are expected to be present on May 11, 2023, and to be prepared to try the case. It is further

ORDERED that the parties shall refer to the notice setting case for trial (Doc. 17) served January 17, 2023, and that the parties shall comply with the Court's standing pretrial order (Doc. 18) served January 17, 2023, for the completion of their pretrial trial activity in this case.
