We REINSTATE this appeal.

We abated this appeal for the trial court to hold a hearing and make findings and recommendations concerning appellant's counsel's failure to file appellant's brief. The trial court held the hearing on March 19, 2024. At the hearing, appellant's counsel, J. Daniel Oliphant, stated that based on his current caseload of trials and appeals, he was behind, "but I am trying to get it done." Mr. Oliphant requested an additional sixty days to file the brief. The attorney for the State said there was no objection to the request. The trial court stated the court would "give you the extra time in order to do that."

We accept the trial court's recommendation, and we order Mr. Oliphant to file appellant's brief on or before MAY 20, 2024.
