VICTOR MANUEL GONZALEZ, Appellant, v. THE STATE OF TEXAS, Appellee.

On appeal from the 464th District Court of Hidalgo County, Texas.

Before Contreras Chief Justice and Silva and Peña Justices

ORDER

PER CURIAM

This cause is before the Court on the reporters' failure to file the record. The reporter's record in this matter was originally due on May 23, 2023, and the court reporter, Angela Zuniga, previously requested and received six extensions of time to file the record. On November 15, 2023, we abated this cause and remanded the matter to the trial court to determine the status of the reporter's record. On November 21, 2023, the trial court judge provided the status that the court reporter had returned from medical leave and indicated the reporter's record would be filed by December 15, 2023.

On January 31, 2024, the Clerk of the Court notified the court reporter that the reporter's record had not been received, and she was instructed to file the reporter's record within ten days. However, to date, no reporter's record has been submitted and the court reporter has not responded to the notice or otherwise requested an extension.

This sequence of events requires us to effectuate our responsibility to avoid further delay and to preserve the parties' rights. See Tex. R. App. P. 37.3(a)(1). The Court, having fully examined and considered the extensions previously granted in this cause, is of the opinion that, in the interest of justice, an order should be entered. The Court looks with disfavor upon the delay caused by the reporter's failure to have heretofore filed the record in this matter.

Reporter, Angela Zuniga, is hereby ORDERED to file the reporter's record in this Court no later than 5:00 p.m. on March 11, 2024. No further motions for extension of time will be entertained by the Court. If the reporter fails to file the record within the foregoing specified period of time, the Court will act appropriately to avoid further delay and to preserve the parties' rights. Tex.R.App.P. 37.3 (a)(2).
