On appeal from the 156th District Court of Live Oak County, Texas.
Before Chief Justice Contreras and Justices Silva and Peña
ORDER
PER CURIAM
This cause is before the Court on appellant's sixth motion for extension of time to file the brief. Appellant's brief was originally due to be filed on May 15, 2023. Appellant's current counsel has been granted three extensions and now requests an additional thirty days. On November 30, 2023, appellant's counsel was ordered to file appellant's brief on or before December 13, 2023, and was further ordered to appear in person on December 14, 2023, at 10:00 a.m. in the Courtroom of the Thirteenth Court of Appeals.
Appellant's counsel failed to file the brief and did not appear as ordered. The Court looks with disfavor upon appellant's counsel's disregarding of its Order.
Accordingly, appellant's sixth motion for extension of time to file the brief is hereby denied. IT IS THEREFORE ORDERED that the Honorable Diamond DeLeon, counsel for appellant, file an appellate brief with this Court instanter.
IT IS FURTHER ORDERED that the Honorable Diamond DeLeon shall appear IN PERSON on December 20, 2023, at 10:30 a.m. in the Courtroom of the Thirteenth Court of Appeals, located at the Nueces County Courthouse, 901 Leopard Street, 10th Floor in Corpus Christi, Texas, to show cause why he should not be held in contempt of court for both failing to file appellant's brief and failing to appear to a show-cause setting.
