ORDER
Plaintiffs AGUSTIN GONZALEZ, JESUS GONZALEZ, HECTOR GONZALEZ, NICOLAS GONZALEZ, JUAN GUTIERRES, MIGUEL MARAVILLAS, FERNANDO SANCHEZ, and LUIS VASQUEZ. Application for approval of: 1). Settlement Agreement; 2). Settlement Distribution Plan; 3). the Terms of Temporary Injunction for eighteen months; 4). The Dismissal with Prejudice of Defendants Charles W. Spaletta and Tony Spaletta; 5). Dismissal without and with Prejudice of SPALETTA RANCH CORPORATION came on for hearing on July 21, 2003, at 10:00 a.m. before the Thelton Henderson.
The Court, having heard argument and reviewing the documents submitted by the parties, and good cause appearing,
HEREBY ORDERS, ADJUDGES and DECREES that:
1. The Settlement Agreement between the Plaintiffs and the Defendants that has been lodged with the Court is fair, reasonable and adequate, and in the interest of the General Public; and is hereby approved.
2. The settlement distribution plan has been approved. The claims period shall commence immediately and shall conclude September 30, 2003. All funds shall be distributed under the plan by December 31, 2003.
3. Defendants CHARLES SPALETTA and TONY SPALETTA are dismissed with prejudice from this action.
4. Defendant SPALETTA RANCH CORP. is dismissed with prejudice from this action.
