Opinion

CASE NO. 1178 CRD-8-91-2

MAY 21, 1992

The claimant was represented by A. Jeffrey Somers, Esq. and Paul A. Morello, Jr., Donovan Morello.

The respondents were represented by Jeffrey Schwartz, Esq., Montstream May.

This Petition for Review from the January 30, 1991 Finding and Award of the Commissioner for the Eighth District was decided on the basis of papers submitted for the January 24, 1992 hearing before a Compensation Review Division panel consisting of the Commission Chairman, John Arcudi and Commissioners Robin Waller and Angelo dos Santos.

OPINION

As agreed by the parties, this matter is being decided without oral argument on the papers submitted. Insofar as we can judge from the confusing succession of documents submitted for respondents' appeal, the appellants contest the chiropractic therapy received by the claimant because "said treatment is not curative." Respondents also want the appeal to be considered "essentially a motion for remand for clarification and/or further findings of fact."

But the respondents never filed any brief or memorandum with this tribunal in support of their argument. Consequently, we have not been directed to any portions of the transcript or to any of the exhibits to justify their claims. It is not our duty on appeal "to cull out the evidence relating to the several corrections claimed" . . . . Sorrentino v. Cersosimo, 103 Conn. 426, 429 (1925).

Under the circumstances we must dismiss the appeal and affirm the commissioner's award.

Having so concluded, pursuant to Sec. 31-301c(b), we grant interest at the rate permitted by statute on any amount remaining unpaid during the pendency of this appeal.

Commissioners Robin Waller and Angelo dos Santos concur.
