444 So. 2d 1132 (Fla. Dist. Ct. App. 1984)

Opinion

No. 83-929.

February 8, 1984.

Appeal from Circuit Court, Palm Beach County; Edward Rodgers, Judge.

Diego C. Asencio of Law Offices of Jose G. Rodriguez, West Palm Beach, for appellant.

Patrick J. Malone of Brennan, McAliley, Hayskar, McAliley Jefferson, West Palm Beach, for appellee Addi Co.

Kathryn M. Beamer of Schuler Wilkerson, West Palm Beach for appellee Barber Greene Co.

We disagree that Workers' Compensation immunity appears on the face of plaintiff's complaint. We reverse the order dismissing plaintiff's third amended complaint without prejudice to Workmens' Compensation being raised as an affirmative defense. See Sullivan v. Liberty Mut. Ins. Co., 367 So.2d 658 (Fla. 4th DCA 1979), cert. denied 378 So.2d 350 (Fla. 1979).

Reversed and Remanded.

ANSTEAD, C.J., and BERANEK and WALDEN, JJ., concur.
