Motion by respondent to vacate the statutory stay which resulted from the notice of appeal (CPLR 5519, subd. [a]). Motion dismissed as academic. The appeal is decided herewith ( Gondoliers v. State Liq. Auth., 34 A.D.2d 791). Christ, P.J., Hopkins, Kleinfeld, Brennan and Benjamin, JJ., concur.
