We affirm the judgment of the trial court on the authority of Waters v. Merritt, 277 Ala. 346, 170 So.2d 492 (1964). See, also, Tyson v. Weil, 169 Ala. 558, 53 So. 912 (1910), and Penny v. Quinn, 16 Ala. App. 251, 77 So. 240 (1917).

AFFIRMED.
