The decision of the Appellate Division dated February 2, 2009, is affirmed. The Dedham District Court is to issue an execution forthwith to the landlord for possession. The Brookline District Court clerk-magistrate is to release forthwith all of the use and occupancy funds in the escrow account established with docket number 0509-SU-0056, related to the tenant's account.
