The reporter's record in this case is past due. By postcard dated November 27, 2023, we notified Janet Wright, Official Court Reporter for County Court at Law No 3, that the reporter's record was overdue and directed her to file the reporter's record within thirty days. By order dated February 9, 2024, we again notified Ms. Wright that the reporter's record was overdue. We ordered Ms. Wright to file the record with fifteen days. To date, Ms. Wright has failed to comply with the Court's order and has not corresponded with the Court regarding the status of the reporter's record.
This appeal cannot proceed until the issue of the reporter's record is resolved. Accordingly, we ORDER Official Court Reporter Janet Wright, to file, within FIFTEEN DAYS of the date of this order, either (1) the reporter's record; (2) written verification no hearings were recorded; or (3) written verification appellant has not requested the record. We notify appellant that if we receive verification the reporter's record has not been requested, we will order the appeal submitted without the reporter's record. See Tex. R. App. P. 37.3(c).
Our records indicate appellant is entitled to proceed without payment of costs.
We expressly CAUTION Ms. Wright that failure to comply with this order may result in this Court abating the case for a hearing to determine the status of the reporter's record and an order that Ms. Wright not sit as a court reporter until such time as she complies with the Court's orders.
