United States District Court, D. Idaho
Jul 17, 2003
CASE NO. CV 03-268-S-MHW (D. Idaho Jul. 17, 2003)

Opinion

CASE NO. CV 03-268-S-MHW.

July 17, 2003.

ORDER

Currently pending before the Court for its consideration is Defendants' Petition for Enlargement of Time or, in the Alternative, Petition to Stay the Proceedings (Docket No. 4), filed July 7, 2003. Having reviewed the motion, the Court finds that Defendants have demonstrated good cause to stay the proceedings in this case on the grounds that Plaintiff has failed to exhaust her administrative remedies. Specifically, Plaintiff has Failed to obtain a right to sue letter from either the Equal Employment Opportunity Commission or the Idaho Human Rights Commission. Accordingly, this case cannot proceed until Plaintiff obtains such a letter.

The Court, however, will not stay this matter for some indefinite period of time. Instead, the Court will conduct a status conference on August 12, 2003 at 2:00 p.m. MST to inquire whether Plaintiff has received a right to sue letter.

If Plaintiff receives her right to sue letter before the scheduled status conference, the Court directs the parties to file their Proposed Litigation Plan on or before Monday, August 11, 2003 at 5:00 p.m. and the Court will conduct a scheduling conference to set the necessary case management deadlines.

Based on the foregoing, the Court being otherwise fully advised in the premises, IT IS HEREBY ORDERED that, Defendants' Petition for Enlargement of Time or, in the Alternative, Petition to Stay the Proceedings (Docket No. 4), filed July 7, 2003, is GRANTED.
