Opinion

Term No. 46M15. (Abstract of. Decision.)

Opinion filed October 15, 1946 Rehearing denied November 26, 1946 Released for publication November 26, 1946

HUSBAND AND WIFE, § 204when allowance of attorney's fees in separate maintenance action was not unreasonable. Allowance of $1,000 as attorney's fees in separate maintenance action was not unreasonable, where testimony of two practicing attorneys as to reasonableness of fee was before court and there was no evidence presented to contrary, since amount of an allowance for attorney fees rests largely in discretion of chancellor and will not be disturbed unless chancellor has clearly exceeded his discretion.
