James GLESSNER, Appellant v. The STATE of Texas, Appellee

From the 25th Judicial District Court, Guadalupe County, Texas
Trial Court No. 13-1379-CR-C
The Honorable William Old, Judge Presiding

ORDER

On March 3, 2016, we abated this appeal to the trial court to hold a hearing to determine whether appellant is indigent, and if so, to appoint new appellate counsel. See Duncan v. State, 653 S.W.2d 38, 40 (Tex. Crim. App. 1983) (holding that appellate courts may abate appeals so that trial court can assure appellant has effective assistance of counsel). On March 23, 2016, the trial court clerk filed a supplemental clerk's record containing an order of appointing attorney on appeal. Accordingly, the appeal is REINSTATED on the docket of this court. The reporter's record is due 30 days from the date of this order.

Rebeca C. Martinez, Justice

IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of the said court on this 31st day of March, 2016.
