Glenn v. State

District Court of Appeal of Florida, Fifth District
Jul 21, 1995
657 So. 2d 970 (Fla. Dist. Ct. App. 1995)

Opinion

No. 94-2013.

July 21, 1995.

Appeal from the Circuit Court for St. Johns County; Richard O. Watson, Judge.

James B. Gibson, Public Defender, and M.A. Lucas, Asst. Public Defender, Daytona Beach, for appellant.

No appearance for appellee.

We affirm the judgment and sentence in this Anders appeal, except for the assessment of $100 for a public defender's fee. The trial court failed to inform appellant of his right to contest the amount of the fee as required by Florida Rule of Criminal Procedure 3.720(d)(1), so the fee is stricken without prejudice to reimpose it after compliance with the rule.

Anders v. California, 386 U.S. 738, 87 S.Ct. 1396, 18 L.Ed.2d 493 (1967).

AFFIRMED AS MODIFIED.

GOSHORN and THOMPSON, JJ., concur.
