STREET RAILWAYS, § 173 — when proper, in action by alighting passenger against street car company, to direct verdict for defendant. In action for injuries to alighting street car passenger who was struck by automobile while stepping from defendant's street car, held trial court properly directed verdict for defendant where it appeared that plaintiff saw headlights of automobile just before he stepped down from rear platform of street car to pavement and he was aware of fact that automobile was being driven in same direction only a short distance back of street car but nevertheless stepped down from platform without looking to see how close automobile was and proceeded to walk leisurely toward curb without paying any attention to approaching automobile.
