Gjonbalaj v. Kenny

Appellate Division of the Supreme Court of New York, First Department
Mar 23, 1993
191 A.D.2d 354 (N.Y. App. Div. 1993)

Opinion

March 23, 1993

Appeal from the Supreme Court, Bronx County (Bertram Katz, J.).

Where, as here, plaintiff's injuries are probative on the issue of liability, denial of bifurcation was clearly an appropriate exercise of discretion (see, Parmar v. Skinner, 154 A.D.2d 444, 445), if not required to avoid prejudice.

Concur — Ellerin, J.P., Wallach, Kupferman and Asch, JJ.
