SCHEDULING ORDER

Appeal by Sadrud-Din Shah from an order of the Family Court, Rockland County, dated October 16, 2023. By order on certification of this Court dated January 19, 2024, the appellant was granted leave to proceed as a poor person on the appeal, and Geoffrey E. Chanin. P.O. Box 967, 4 Hampton Road, Goshen, NY 10924, was assigned as counsel to prosecute the appeal. Additionally, assigned counsel was directed to promptly attempt to contact the appellant at the address provided by this Court, and on or before February 9, 2024, notify the Case Manager assigned to the appeal, in writing, that he has done so and that either (1) the appellant is interested in prosecuting the appeal, or (2) the appellant is not interested in prosecuting the appeal, or that he has been unable to contact the appellant, and wishes to be relieved of the assignment. Assigned counsel has failed to advise this Court whether the appellant is interested in prosecuting the appeal. Pursuant to § 670.3(b) of the rules of this Court (22 NYCRR 670.3[b]), it is

ORDERED that assigned counsel shall promptly attempt to contact the appellant at the address provided by this Court, and on or before May 17, 2024, shall notify the Case Manager assigned to the appeal, in writing, that he has done so and that either

(1) the appellant is interested in prosecuting the appeal, or

(2) the appellant is not interested in prosecuting the appeal, or that he has been unable to contact the appellant, and wishes to be relieved of the assignment; and it is further, ORDERED that if assigned counsel fails to so notify the Case Manager assigned to the appeal on or before May 17, 2024, the Clerk of this Court, or his designee, shall issue an order to all parties to the appeal to show cause why the appeal should or should not be dismissed.
