Gibson v. State

District Court of Appeal of Florida, First District
Sep 11, 1992
604 So. 2d 40 (Fla. Dist. Ct. App. 1992)

Opinion

No. 90-3406.

September 11, 1992.

An Appeal from the Circuit Court for Bay County; Clinton Foster, Judge.

Nancy A. Daniels, Public Defender, and Glen P. Gifford, Asst. Public Defender, Tallahassee, for appellant.

Robert A. Butterworth, Atty. Gen., and Bradley R. Bischoff, Asst. Atty. Gen., Tallahassee, for appellee.

In Gibson v. State, 593 So.2d 1064 (Fla. 1st DCA 1992), we reversed Gibson's sentencing as a habitual offender. The supreme court quashed our reversal of Gibson's sentence as a habitual offender in State v. Gibson, 601 So.2d 226 (Fla. 1992). Accordingly, we affirm the sentence imposed by the trial court.

AFFIRMED.

ERVIN and KAHN, JJ., concur.
