Gibbs v. Citibank

Court of Appeals of Texas, Fifth District, Dallas
Apr 28, 2009
No. 05-08-01490-CV (Tex. App. Apr. 28, 2009)

Opinion

No. 05-08-01490-CV

Opinion Filed April 28, 2009.

On Appeal from the 296th Judicial District Court Collin County, Texas, Trial Court Cause No. 296-00621-08.

Before Chief Justice THOMAS and Justices O'NEILL and MURPHY.

MEMORANDUM OPINION

By letter dated March 12, 2009, this Court notified appellant that the brief he tendered on March 10, did not comply with Texas Rule of Appellate Procedure 38.1. We directed appellant to file, within ten days, an amended brief that corrected the identified deficiencies, and gave appellant an extension of time to file his amended brief. We warned appellant that failure to file an amended brief that complied with the Texas Rules of Appellate Procedure would result in dismissal of the appeal. On April 16, 2009, appellant filed an amended brief. The amended brief, however, did not correct all of the deficiencies noted in the original brief. Specific deficiencies include appellant's failure to provide any citation to either the record or to authorities.

Accordingly, we strike appellant's brief and dismiss the appeal. See Tex. R. App. P. 38.8(a), 42.3(c).
