FINAL JUDGMENT


Pursuant to the Order issued this same day and Federal Rule of Civil Procedure 58, it is ORDERED, ADJUDGED, and DECREED that Plaintiff General Electric Capital Corporation is entitled to judgment as a matter of law.

It is accordingly ORDERED that General Electric Capital Corporation recover from Defendant Debra McCauley as follows:

1. Damages in the amount of $147,827.40, plus prejudgment interest on that amount at the rate of 18% per annum from October 1, 2001 until the entry of judgment.
2. Attorneys' fees in the amount of $7,118. If Notice of Satisfaction of Judgment is filed with this Court within 45 days of the entry of this summary judgment, then McCauley will be entitled to a remittitur against this summary judgment in the amount of $1,765. Further, General Electric Capital Corporation is conditionally awarded $4,600 in attorney's fees should McCauley appeal this case to the Court of Appeals for the Fifth Circuit and $4,600 should McCauley file an application for writ of certiorari with the United States Supreme Court.

3. Court costs in the amount of $281.

4. Post-judgment interest on the judgment amount at the rate of 3.59% per annum from the date of this judgment until judgment is satisfied.

It is FURTHER ORDERED that Plaintiff have all writs of execution and other process necessary to enforce this judgment.
