DECISION & ORDER ON MOTION

Motion by respondent to dismiss an appeal from an order of the Civil Court of the City of New York, Queens County, entered November 28, 2011, and for sanctions.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion seeking to dismiss the appeal is denied as moot as the appeal was dismissed by decision and order of this court dated March 2, 2012; and it is further,

ORDERED that the branch of the motion seeking sanctions is denied.
