The Court abated this appeal for mediation on June 1, 2023. Mediation was set to occur on September 5, 2023. On December 5, 2023, the Court issued an order requesting responses from the parties concerning the outcome of mediation. On the same date as our order issued, the Court received a copy of a letter from appellant's counsel requesting an extension of the terms of payment of the amount contained in the mediated settlement agreement. Although this letter tends to indicate that the parties reached a settlement, neither party has responded to this Court's December 5, 2023 order, requesting responses within 10 days.
The Court may reinstate the appeal and request immediate payment for the clerk's record unless the parties update the Court regarding the status of any settlement. Response to this order is due by February 12, 2024.
It is so ORDERED.
