Isaac GARZA, Appellant v. The STATE of Texas, Appellee

From the 437th Judicial District Court, Bexar County, Texas Trial Court No. 2020CR12210 Honorable Melisa C. Skinner, Judge Presiding

ORDER

Beth Watkins, Justice.

On February 24, 2023, counsel for appellant filed a motion for voluntary dismissal, requesting that we dismiss the appeal. Texas Rule of Appellate Procedure 42.2(a) requires a motion for voluntary dismissal to be signed by the appellant and his attorney. Tex R. App. P. 42.2(a). Here, the motion filed by counsel lacked appellant's signature. See id. The motion is therefore denied without prejudice to refiling. See Tex R App. P. 42.2(a).
