This appeal has been abated while the parties engaged in mediation. Pending before the Court is Ernesto Garcia's motion to withdraw his notice of appeal pursuant to TEX.R.APP.P. 42.2 because the parties have resolved the dispute through mediation. Given that this is a civil appeal, we have construed the motion as requesting dismissal of the appeal pursuant to TEX.R.APP.P. 42.1(a)(1). We reinstate the appeal, grant the motion, and dismiss the appeal. Costs of the appeal are taxed against Appellant. See TEX.R.APP.P. 42.1(d).
