This case was stricken from the Court's February 1, 2021, San Diego, California trial session and continued, and jurisdiction was retained by this Division of the Court. Since that date, the parties have been filing cookie-cutter status reports, indicating that they are working together and anticipate settling but giving no concrete signs of progress toward resolution. In our last Order we advised the parties "that if they are unable to reach a basis of settlement by [January 7, 2022] or demonstrate progress toward resolution of this case without trial, this case will be set for trial at the Court's February 28, 2022, San Diego, California trial session." As directed by the Court the parties filed a joint Status Report on January 5, 2022. But contrary to our direction, that status report was identical to the previous one, once again giving us no indication that the parties have made any real progress with the additional time we have given them. Without more evidence that the parties are actively working to resolve this case, we do not see the value of delaying trial further. Upon due consideration and for cause, it is
ORDERED that this case is calendared for trial at the Court's February 28, 2022, San Diego, California trial session in Room 4228, 4th Floor, Federal Building, 880 Front Street, San Diego, California, 92101, scheduled to begin at 10:00 am PT. It is further
ORDERED that the Clerk of the Court shall also serve on the parties: (1) a Notice Setting Case for Trial at the Court's February 28, 2022, San Diego, California trial session, and (2) a copy of the Standing Pretrial Order for the Court's February 28, 2022, San Diego, California trial session.
