Opinion

Case No. 1D03-1868.

Opinion filed April 7, 2004. Rehearing Denied May 21, 2004.

Petition for Writ of Certiorari — Original Jurisdiction.

David A. Theriaque, Esq., Steve Pfeiffer, Esq., and S. Brent Spain, Esq. of Theriaque Pfeiffer, Tallahassee; Harold S. Richmond, Esq., Quincy, for Petitioner.

Concluding that the circuit court applied the correct law in granting respondent's petition for a writ of certiorari, we deny petitioner's petition for a writ of certiorari. See Fla. DENIED.

BARFIELD, BROWNING and LEWIS, JJ., CONCUR.

NOT FINAL UNTIL TIME EXPIRES TO FILE MOTION FOR REHEARING AND DISPOSITION THEREOF IF FILED
