STIPULATION OF DISMISSAL
IT IS HEREBY STIPULATED by and between the parties to this action through their designated counsel that the above-captioned action be and hereby is dismissed with prejudice pursuant to FRCP 41(a)(1) with respect to plaintiffs Mark Furusho and Yaeko Furusho.
IT IS FURTHER STIPULATED by and between the parties to this action through their designated counsel that the above-captioned action be and hereby is dismissed pursuant to FRCP 41(a)(1) as to plaintiff Burnside Road Ranch Property, a joint venture: (1) without prejudice with respect to the "Crop Loans" referenced in paragraph 14, et seq., of the Complaint herein, and (2) with prejudice with respect to the other matters raised by the Complaint, specifically the "FSA Loan" referenced in paragraph 12, et seq. of the Complaint.
IT IS FURTHER STIPULATED that each party is to bear its own costs and fees.
