On December 9, 2021, the parties filed a joint status report requesting a con ference call with the Court to discuss scheduling this case for trial. On December 22, 2021, the undersigned held a conference call with the parties during which they stated their intention to file cross-motions for partial summary judgment. They also indicated their willingness to try the issues not addressed by their cross-motions during a Spring 2022 remote trial session. Depending on witness availa bility, a remote trial could be held during be the April 11, 2022, New York session or the June 13, 2022, fully-remote session. The undersigned will be presiding over both trial sessions. In consideration of the foregoing, it is

ORDERED that the parties shall file with the Court, on or before January 5, 2022, a joint status report (1) setting forth a proposed briefing schedule for the cross-motions for partial summary judgment and (2) indicating the trial session (and if possible, a time and date certain) during which they wish to try the re main ing issues in the case.
