ORDER


The motion of defendant China Express Forwarders Co., Ltd., to vacate the default judgment entered against it is denied as moot in light of the settlement between plaintiff and that defendant. In the circumstances, there is no need to comment upon the objections to the magistrate judge's report and recommendation interposed by defendant UCM Shipping Agency, Inc.

SO ORDERED.
