On order of the Chief Justice, the motion by plaintiff-appellant for an extension of the time for filing the brief and appendix on appeal is considered and, it appearing the brief and appendix were filed February 1, 1999, an extension of time until that date is GRANTED.
The motion by Tip of the Mitt Watershed Council, et al, for leave to file a brief as amicus curiae is also considered and it is GRANTED.
