MEMORANDUM OPINION


After one extension, appellant's brief was due on December 23, 2002. Appellant has not filed his brief nor has he responded to the Clerk's letter of January 6, 2003 warning him that his appeal would be dismissed if he did not file the brief and an extension motion within ten days. In an earlier order, the Court deferred ruling on appellees' September 4, 2002 motion to dismiss which complained of appellant's failure to file a brief. We now GRANT appellees' motion to dismiss. This appeal is DISMISSED. See Tex.R.App.P. 38.8(a)(1), 42.3(b), (c).
