ORDER MODIFYING OPINION

RICHLI, J.

The opinion filed in this matter on April 25, 2008 is modified as follows:

On page 29, immediately before the existing text, the following is added:

“In addition, the order awarding attorney fees against Freeman is reversed. The trial court is directed to enter an order denying defendants’ motion for attorney fees.”

Except for this modification, the opinion remains unchanged. This modification changes the judgment.
