Whatever relief may be available to petitioner under state law, the refusal to give a lesser included offense instruction does not state a claim cognizable in federal habeas corpus. Cooper v. Supp. 679 (W.D.Mo. 1979); Boothe v. Wyrick, 452 F. Supp. 1304 (W.D.Mo. 1978); Young v. Wyrick, 451 F. Supp. 576 (W.D.Mo. 1978). Petitioner is not entitled to relief on this ground.
