ORDER


Defendants' motion for summary judgment dismissing the complaint is granted to the extent that plaintiff's claims of discriminatory discharge, disparate treatment and retaliation related to his performance review are dismissed and denied in all other respects for the reasons set forth in the report and recommendation of Magistrate Judge James C. Francis, IV. Defendants' objections, which in major respects in substance seek to argue the weight of the evidence, are overruled.

SO ORDERED.
