ORDERED as follows:

1. That the Recommendation be and is hereby ADOPTED; and

2. That Foy's Motion for Preliminary Injunction (Doc. # 10) be DENIED.

3. That this case is referred back to the Magistrate Judge for appropriate proceedings.
