Present — Carswell, Acting P.J., Johnston, Adel, Wenzel and MacCrate, JJ. [See ante, p. 859.]


Motion by plaintiff-appellant for reargument to a stated limited extent granted with respect to the question of costs and disbursements and, on such reargument, the decision of this court handed down December 19, 1949, is amended by striking from the decretal paragraph the words "without costs" and by inserting in place thereof the words "with ten dollars costs and disbursements to appellant against respondent Fox."
