ORDER


On October 15, 2010, final judgment was entered dismissing this action as frivolous within the meaning of 28 U.S.C. § 1915(e)(2)(B). Judgment, Doc. No. 8. The Court also concluded that an appeal from that judgment would be frivolous and not taken in good faith. Order, Doc. No. 7. On November 9, 2010, plaintiff filed an "Affidavit of Indigence," Doc. No. 9, which the Court deems a motion for leave to proceed on appeal in forma pauperis.

For the reasons stated in the Report and Recommendation, Doc. No. 5, and in this Court's order adopting that Report and Recommendation, Order, Doc. No. 7, plaintiff's motion for leave to proceed on appeal in forma, pauper is is DENIED. 11-15-2010 Date
