This case was consolidated for trial and appeal with a companion suit, Charles L. Liberto, Jr. v. Joseph Villard and Mucavil, Inc., 386 So.2d 930 which is being decided on this date.

For the reasons which we assigned in Charles L. Liberto, Jr. v. Joseph Villard and Mucavil, Inc., supra, the judgment appealed from in the instant suit is affirmed. The costs of this appeal are assessed to defendant-third party plaintiff-appellant, Charles L. Liberto, Jr.

AFFIRMED.
