The Florida Bar filed a complaint against Eugene Paul Brinn, alleging violations of the Rules Regulating The Florida Bar. The referee held a hearing and concluded, on technical grounds, that the grievance committee's finding of no probable cause was final and that the Bar's complaint must be dismissed. The referee issued a recommended order of dismissal, without reaching the merits of the complaint. The Bar has petitioned for review. Having considered the recommended order and the briefs filed by the parties, the Court approves the referee's recommendation and dismisses this matter without prejudice. See R. Regulating Fla. Bar 3-7.4(j)(3).
