The Court approves the uncontested referee's report as to indirect criminal contempt, which was filed with this Court on March 3, 2011. Respondent is found not guilty of the alleged misconduct, and the petition to show cause is hereby dismissed.
The order to show cause for indirect criminal contempt issued by this Court on October 9, 2009, is hereby discharged as Respondent Walker was not shown to have the present ability to pay the restitution and monetary penalty assessed in this Court's order dated January 25, 2007.
As previously stated in this Court's order dated January 25, 2007, Addys T. Walker shall pay restitution in the amount of $17,500.00 to Christopher Watson, in the amount of $7,500.00 to Henry Watson, in the amount of $700.00 to John Hill, Jr., and in the amount of $1,200.00 to Linda Shabazz under the terms and conditions set forth in the prior report. Addys T. Walker shall provide a monthly written report to the UPL Department of The Florida Bar detailing to the petitioner to whom restitution has been made and the amounts paid.
Also, as previously stated in this Court's order dated January 25, 2007, Respondent is assessed a $6,000.00 civil penalty pursuant to Rule 10-7.1(d)(1) of the Rules Regulating The Florida Bar, which shall be paid to this Court within sixty days after service of this order. This order is without prejudice to The Florida Bar to seek enforcement in the future.
Respondent shall not engage in the unlicensed practice of law and the injunction dated January 25, 2007, enjoining respondent from engaging in the unlicensed practice of law in Florida shall continue in its present form.
Each party shall bear its own costs in the indirect criminal contempt proceeding.
The Clerk shall place this file in the closed category to be reopened only if further enforcement actions are filed.
Not final until time expires to file motion for rehearing, and if filed, determined.
