ORDER

This case is currently calendared for trial during the Court's Seattle, Washington trial session, scheduled to begin February 12, 2024.

On January 22, 2024, the Commissioner filed a motion to dismiss for failure to properly prosecute. The Court will direct petitioner Juan Flores to file a response to the motion and appear at the above-referenced trial session to be heard on the motion. Accordingly, it is

ORDERED that, on or before February 6, 2024, Mr. Flores shall file a response to the motion to dismiss for failure to properly prosecute. It is further

ORDERED that the Commissioner's motion to dismiss for failure to properly prosecute is set for hearing at the calendar call of the Court's Seattle, Washington trial session, scheduled to begin at 10:00 a.m., on February 12, 2024, in Room 4, 3rd Floor, at the Nakamura U.S. Courthouse, 1010 5th Avenue, Seattle, Washington 98104. If Mr. Flores fails to file a response to the motion or fails to appear at the hearing, the Court may grant the motion and enter a decision against him in the amount set forth therein.
