IN RE THE MARRIAGE OF: ALIA DAY FLOREN, Petitioner and Appellee, v. JAVIER BAUTISTA-SCHEUBER, Respondent and Appellant.

ORDER

Mike McGrath Chief Justice, Montana Supreme Court.

Appellant Javier Bautista-Scheuber, representing himself, has moved this Court for leave to file his Reply Brief electronically. Bautista-Scheuber asserts that he has a visual impairment which precludes him from checking a hard copy of his brief for accuracy and he requests that he be permitted to submit his brief via e-mail. Bautista-Scheuber further indicates that counsel for Appellee Alia Day Floren has been contacted and Floren does not object to this accommodation.

IT IS ORDERED that Appellant's motion for leave to file his Reply Brief electronically is GRANTED. Appellant shall prepare, file, and serve the brief on or before January 26, 2022, by e-mailing the brief to clerkofsupremecourt@mt.gov and to opposing counsel.

IT IS FURTHER ORDERED that Appellant must submit the Reply Brief as an attachment to the e-mail in either Microsoft Word or .pdf format and the brief must comply with the applicable Montana Rules of Appellate Procedure in all other respects, including brief contents and word count.

No further extensions will be granted.

The Clerk is directed to provide a true copy of this Order to all parties of record.
