ORDER GRANTING DEFENDANT'S MOTION TO COMPEL


Before the court in this contract dispute is the defendant's motion to compel discovery, filed February 6, 2003. The motion was referred to the United States Magistrate Judge for determination.

The plaintiff has not filed a response to the motion, and the time for responding has now expired. Local Rule 7.2(a)(2) requires that responses to civil motions be filed within fifteen days of service. Rule 7.2(a)(2) further provides that "[f]ailure to respond timely to any motion . . . may be deemed good grounds for granting the motion."

In the absence of a response, the defendant's motion to compel is granted. Fleet Business Credit is instructed to respond to the defendant's interrogatories and requests for production of documents served on or about October 11, 2002, within eleven (11) days from the date of this order. Fleet Business Credit is warned that, henceforth, failure to comply with proper discovery requests may lead to dismissal of its complaint.
