In Re: Louisiana Department of Natural Resources, applying for supervisory writs, 23rd Judicial District Court, Parish of Assumption, No. 34316. BEFORE: DRAKE, HOLDRIDGE AND CHUTZ, JJ.

Holdridge, J., dissents and would grant the writ in part with order as to the portion of the judgment which denied the exception of improper venue filed by the State of Louisiana, through the Department of Natural Resources. The mandatory venue provisions of La. R.S. 13:5104 are applicable, and venue for the Third Party Demand is proper in the Parish of East Baton Rouge. I would grant the exception of improper venue filed by the State of Louisiana, through the Department of Natural Resources and remand this matter to the district court for transfer of the Third Party Demand to the Parish of East Baton Rouge.
