THE FLORIDA BAR, Complainant(s) v. Edward Mitchell WHALEY, Respondent(s).


The Notice of Adjudication of Incapacity, treated as a Petition for Placement on the Inactive List, filed in the above cause is granted and Edward Mitchell Whaley is hereby classified as an inactive member pursuant to Rule 3–7.13 of the Rules Regulating The Florida Bar. Based on the Fifth Judicial Circuit Court Order Determining Total Incapacity, respondent is no longer practicing law, therefore placement on the inactive list is effective immediately. Respondent shall fully comply with Rule Regulating the Florida Bar 3–5.1(h).

Not final until time expires to file motion for rehearing, and if filed, determined. The filing of a motion for rehearing shall not alter the effective date of placement on the inactive list.
