ORDER


On October 20, 2003, plaintiff Shirley A Fisk filed a complaint alleging 42 U.S.C. § 1983 civil rights violations, as well as several state law causes of action. Doc # 1. Plaintiff filed a motion for leave to proceed in forma pauperis on that same date. Doc # 3. On November 12, 2003, the court denied plaintiff's motion for leave to proceed in forma pauperis. Doc # 4. Finding that plaintiff's complaint both failed to state a claim on which relief may be granted and sought monetary relief against defendants who were immune from such relief, the court dismissed plaintiff's complaint without prejudice. The court also gave plaintiff leave to file an amended complaint that corrected such deficiencies.

As of February 17, 2004, plaintiff has not filed an amended complaint. Accordingly, the court ORDERS that the clerk close the file and terminate all pending motions in this case.

IT IS SO ORDERED.
