JOSEPH DEAN FISHER, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the 422nd Judicial District Court Kaufman County, Texas Trial Court Cause No. 20-00307-422-F

ORDER

DENNISE GARCIA JUSTICE.

Before the Court is appellant's October 31, 2022 motion to extend the time to file his brief. We GRANT the motion and ORDER appellant's brief filed by November 30, 2022. If appellant fails to file his brief by November 30, 2022, the Court may abate this case for a hearing in the trial court to determine why the brief has not been filed. See Tex. R. App. P. 38.8(b).

The Court observes that appellant's brief in this appeal was due originally on March 9, 2022. After two abatements for hearings in the trial court on why the brief was not filed, the Court removed appellant's original counsel and current counsel was appointed. Although current appellate counsel is not responsible for the substantial delay in filing appellant's brief, we urge counsel to file appellant's brief as expeditiously as possible.
